TOSB ONLINE BANKING TERMS AND
CONDITIONS
Welcome to Twin Oaks Savings Bank (TOSB) Online Banking Service. Your
use of TOSB’s Online Banking Service is subject to all terms and
conditions contained in this Online Agreement (the “Agreement”). Please
read the Agreement carefully before proceeding. For by checking the “I
Accept” box on the physical application, you are (1) acknowledging your
receipt of the information listed below, (2) agreeing that any contract
you enter into with TOSB for the provision of certain On-line Banking
Services, may be in electronic form, and (3) agreeing that certain
information that may be delivered in connection with the Services may
also be in electronic form.
You agree to the rules in this Agreement every time your password is
used to access TOSB’s Online Banking Service. Your use of the Online
Banking Service is also subject to all of the terms, conditions, rules
and regulations contained in your signature card agreement, unless
otherwise noted in this agreement, or other documents applicable to your
account and in any amendments thereto.
You must access TOSB’s Online Banking service in the ways described in
these terms and conditions and in any amendment notices issued by TOSB
in the future. Notice to you may occur in a number of ways, including
email to your last known email address, mail to your last known address,
electronically via the Internet, and/or notices posted in our branch
offices. TOSB reserves the right to change these terms and conditions at
anytime by giving you 14 days notice.
To be eligible to use the Online Banking Service, you must open or
maintain a deposit account at Twin Oaks Savings Bank, you must complete
an application and you must be at least 18 years of age. You must
maintain your account in good standing with TOSB in order to perform
transactions through those accounts using the Online Banking Service.
Approval to use the Online Banking Service is at our discretion and we
reserve the right to subsequently cancel your access to the service.
Online Banking Service
The Online Banking Service may be used to:
- Access your account balances and review transactions.
- Transfer funds between your bank account(s). Please note
transfers made online may not appear in your transaction history
immediately, however, they will be reflected in your balance.
Because regulations require the Bank to limit pre-authorized
transfers, including Online Banking transfers from certain types of
accounts, the following limitations apply:
- For security reasons, we may limit the frequency and dollar
amount of transactions from your account.
- We may modify the services available through Online Banking
from time to time in accordance with applicable law. Additional
services may become accessible in the future. As each becomes
available, you will be provided with a description of each
service and any account fees associated with the service, and
you will be given the opportunity to access each through Online
Banking. Your use of these new services or accounts shall mean
that you agree to any additional terms and conditions as well as
payment of fees. In addition, we reserve the right to delete or
modify any services or accounts from Online Banking.
- Pay your loans at TOSB by transferring funds from your
related bank account(s). The outstanding principal balance is
available for your online viewing. You can make a regular loan
payment by transferring funds from your checking or statement
savings account to the loan.
You will continue to receive your regular account statement.
Important Information Regarding Two or More Signature
Accounts
If the account is an account requiring two or more signatures,
you and all signers hereby waive all signature requirements when
using TOSB’s Online Banking Service. You agree that TOSB is
authorized to recognize the ACCESS ID and PASSWORD of either
joint account owner in the payment or transfer of funds from or
the transaction of any business with respect to the account, any
charge against the account for money withdrawn or transferred
there from or advanced against by use of the ACCESS ID or
PASSWORD of either joint account owner shall be valid and you
discharge TOSB from liability with respect to same.
Definitions
“We”, “us”, “our”, “TOSB”, mean Twin Oaks Savings Bank.
“You” or “your” mean either you personally as a customer of TOSB,
or a person authorized by you to operate on your accounts via
the service.
Authorized User-you or any person who is either actually
authorized by you to use TOSB’s Online Banking Service on your
behalf or accesses TOSB’s Online Banking Service using your TOSB
ACCESS ID and ONLINE PASSWORD, whether or not such person has
actual authority to do so.
Business Day – means Monday through Friday except for legal
holidays.
Password – a confidential password used to prevent unauthorized
access to and use of your account(s). When used with your ACCESS
ID it gives access to TOSB’ Online Service.
Transaction – any transaction requested using TOSB Online
Banking Service including requests for transfers between your
accounts.
Operation of the Online Banking Service
You must be careful to ensure that you enter your transaction
details carefully. We are not obliged to effect the electronic
transfer if you do not give us all of the information requested
on the screen, or if any of the information you give us is
inaccurate.
All transfers made via the Online Banking Service are subject to
sufficient funds being available in your account, to meet such
transfers at the time they are to be processed.
Use of Your User Name and Password
You agree not to allow anyone to gain access to the Online
Banking Service or to let anyone know, including family or TOSB
personnel, your Password used with the Online Banking Service.
You are responsible for keeping your password and account data
confidential. Your use of your password will be considered the
same as your written signature in authorizing us to complete any
transactions you may request. TOSB will have no obligation, or
take any further steps, to verify any instructions received from
you or appearing to be sent to you via the Online Banking
Service. Any authorized or other person to whom you give your
password will have full access to your accounts and to the
extent permitted by law, TOSB will not be held responsible for
any claim or loss that results directly or indirectly, from any
unauthorized use or misuse of your ACCESS ID and or Online
Banking Password, unless the loss was the direct result of a
TOSB employee’s gross negligence or willful misconduct. In no
event will TOSB be liable for loss of goodwill, or for special,
incidental, indirect, punitive or consequential loss of damages
of any kind. TOSB shall not be responsible for liability, loss
or damage of any kind resulting from any delay in performance of
or failure to perform its responsibilities due to any cause
beyond TOSB’s reasonable control. You agree to assume
responsibility for all transactions initiated through the Online
Banking Service with your ACCESS ID and Password, up to the
limits allowed by applicable law.
When using the Online Banking Service, you should never leave
your PC unattended, and you should take care that others cannot
see you enter your ACCESS ID or Password.
Business Customers
You must ensure that your Password is kept secure and is only
used by those authorized in writing by you to do so for the
purpose of your business.
You should reconcile your business or financial records with
your bank statements at least monthly so that your instructions
via the Online Banking Service can be monitored by you.
You should also initiate appropriate internal controls to
minimize the risks of fraud.
If Your Password Has Been Lost or Stolen
If you believe your Password has been lost or stolen, contact
our office immediately by calling 815-795-2129, from 9:00a.m.
until 5:00p.m., Central Time, Monday through Friday, Saturday
from 9:00 a.m. until 12:00 p.m., excluding legal holidays. If
you believe someone has transferred or may transfer money from
your account without your permission, immediately call our
office. If you tell us within two (2) Business Days after you
discover that your Password has been lost or stolen, you will be
liable for no more than $50 if someone uses your Password
without your permission. If you do not tell us within two (2)
Business Days after you learn of the loss or theft of your
Password and we can prove we could have stopped someone from
using your Password without your permission if you had advised
us, you could be liable for as much as $500. Liability limits
may not apply if you provide your Access Id and Password to
someone who is not an authorized signor on the affected
account(s).
Electronic Mail
If you send TOSB an electronic mail message, we will be deemed
to have received it on the following Business Day. Do not
include information such as account numbers, social security
numbers, etc. in your e-mail correspondence. We will have a
reasonable time to act on your e-mail.
You should not rely on electronic mail if you need to
communicate with TOSB immediately. For example, if you need to
report the theft of your password or an unauthorized transaction
from one of your accounts, you should contact TOSB immediately
at 815-795-2129. You agree that TOSB may respond to you by
electronic mail with regard to any matter related to the Online
Banking Service, including responding to any claim of
unauthorized electronic funds transfer that you make. Any such
electronic mail sent to you by TOSB shall be considered received
within three (3) calendar days of the date sent by TOSB,
regardless of whether or not you sign on to the Online Banking
Service within that time frame.
Hours of Operation
The Online Banking Service is available 24 hours a day, seven
days a week, except for interruptions due to maintenance or
matters beyond our control (such as earthquakes, severe weather
conditions, power outages, etc.). For purposes of transactions,
TOSB’s Business Days are Monday through Friday, excluding legal
holidays.
Modifications; Notices; Termination
TOSB may modify, amend or revise this Agreement and/or terms and
conditions applicable to any Service at any time and from time
to time, and the revised Agreement or terms and conditions shall
be effective on the date selected by TOSB or at the earliest
date allowed by applicable law. Any notice of revisions shall be
sufficient if we send you a copy of such revisions or if we
notify you that revisions have been made and give you
instructions how to obtain a copy of such revised Agreement or
terms and conditions. Your continued use of the Service after
the effective date of such revisions will constitute your
acceptance of the revisions and the revised agreement. We may
give you any notice under this Agreement or related to any
Service, including notice of revisions or notices under
Regulation E, CC, B, DD, M, or A, by any one or more of the
following methods: by sending notice by first-class mail or
electronic mail at the address shown on our records, by placing
a statement message in the statement for any of your account(s)
or by posting a notice on our Internet site. You will be deemed
to have received any notice by electronic mail three calendar
days after it is sent. We reserve the right to terminate this
Agreement and your use of the Online Banking Service in whole or
in part at any time without prior notice.
If Your Statement Shows Transfers That You Did Not Make
If your statement shows transfers that you did not make or
authorize, contact TOSB immediately by calling 815-795-2129,
9:00a.m. to 5:00 p.m., Central Time, Monday through Friday
excluding holidays. If you do not notify us within sixty (60)
days after the statement was mailed to you, you may not recover
any money lost after the sixty (60) days which would not have
been lost if we had been notified in time.
Liability For Failure to Make a Transfer
We will endeavor to ensure the service is available for your use
at all times, that information provided about your accounts is
current and accurate, and that transactions are processed
accurately and without unreasonable delay.
If we do not complete a transfer to or from your account on time
or in the correct amount according to our Agreement with you, we
will be liable for the amount of any losses or damages incurred
by you and resulting directly from such failure. In no event
will TOSB be liable for loss of goodwill, or for special,
incidental, indirect, punitive or consequential loss of damages
of any kind. TOSB shall not be responsible for liability, loss
or damage of any kind resulting from any delay in performance of
or failure to perform its responsibilities due to any cause
beyond TOSB’s reasonable control, unless the loss was the direct
result of a TOSB employee’s gross negligence or willful
misconduct.
You agree that the Bank will not be liable for failure to
properly complete a transfer in the following instances:
- If through no fault of ours, your account has
insufficient funds to complete a transfer. If a transaction
is processed against insufficient funds, you may have to
repay the amount involved.
- If circumstances beyond our control (such as flood, fire
or power outage) prevent the transfer.
- Your telephone, communication link or service was not
working properly and you knew about the problem when you
started the transfer.
- If your funds are subject to legal process or other
encumbrance restricting the transfer.
- If there is a hold on your account, or if access to your
account is blocked, in accordance with banking policy.
- If you believe someone has accessed your accounts
without your permission and you fail to notify us
immediately.
- If we have a reasonable basis for believing that
unauthorized use of your Password or account has occurred or
may be occurring or if you default under this Agreement, the
deposit account agreement or any other agreement with us, or
if you or we terminate this Agreement.
- You have not properly followed the scheduling
instructions on how to make a transfer included in this
Agreement.
- If we have received incomplete or inaccurate information
from you or a third party involving the account or transfer.
TOSB will not be liable for any losses, resulting from
circumstances over which we have no direct control,
including, but not limited to, the failure of electronic or
mechanical equipment or communications lines, telephone or
other interconnect problems, operator errors, log-in
sequences, severe weather, earthquakes, floods, or other
such events. You acknowledge that there are alternative
methods for accessing the information and conducting the
transactions provided by the Online Banking Service. In the
event, you should experience problems in accessing the
Online Banking Service, you will attempt to access such
information and conduct such transactions by such
alternative methods. There may be other exceptions stated in
this Agreement and in other agreements with you. In no event
shall we be liable for loss of goodwill, or for special,
incidental, indirect, punitive or consequential loss or
damages of any kind.
General Information
We have the statutory right to use any credit balance in any
account you may hold with TOSB to repay any debts that you
owe us. We will notify you if we exercise this right of
set-off on your accounts.
If you transfer funds to another account holder within TOSB,
it is your responsibility to ensure that you have obtained
proper authorizations from that account owner to access
his/her account. TOSB is not liable for any dispute that may
arise between you and the account owner as a result of such
a transfer.
You are responsible for using, having or obtaining a
computer with compatible Internet access. Any charges
relating to that computer or Internet service provider are
also your responsibility.
You should check your accounts promptly after transacting
through the Online Banking Service and, in addition, when
you receive your statement of account you should confirm
that all entries are in accordance with instructions given.
No express or implied warranties are made by TOSB pertaining
to the use of TOSB’s Online Banking Service, including,
without limitation, any implied warranties of
merchantability or fitness for a particular purpose. All
such warranties are hereby disclaimed and excluded by TOSB.

Notification should be made as soon as possible. If you
think your statement is wrong or you need more information
about a transfer listed on your statement, we must hear from
you at the specified telephone number or address no later
than sixty (60) calendar days after we sent you the FIRST
statement on which the problem or error appeared. We will
need:
- Your name, account number, and dollar amount of the
suspected error. Do not tell us your password.
- A description of the error or transfer in question
and an explanation regarding why you believe it is an
error or need more information.
If the suspected error is reported orally, we may
require that you send us your complaint or question in
writing within ten (10) Business Days. We will notify
you with the results of our investigation within ten
(10) Business Days after you contact us and will correct
any error promptly. If more time is needed, however, we
may take up to forty-five (45) calendar days to
investigate your complaint or question. If this occurs,
we will provisionally re-credit your account within ten
(10) Business Days for the
amount you think is in error, so that you will have use
of the funds during the time it takes us to complete our
investigation. If TOSB provisionally re-credits funds to
your account, and TOSB determines there was no error,
you will be notified and the funds will be withdrawn
from the account for the provisionally re-credit amount.
If we ask you to put your complaint or question in
writing and we do not receive it within (10) Business
Days, we may not provisionally re-credit your account
until the investigation is completed and it is
determined that an error did occur.
If your notice or error concerns a transaction that
occurred during the first thirty (30) days after the
first deposit to the account was made, the applicable
time periods are twenty (20) business days in place of
ten (10) business days and ninety (90) days in place of
forty-five (45) days. We will tell you the results of
our investigation within three (3) Business Days after
completing our investigation. If we determine that no
error occurred, we will send you a written explanation.
You may request copies of the documents that we used in
the investigation. If we provisionally re-credited funds
to your Account and we determine there was no error, the
funds will be withdrawn from your account for the
provisionally re-credited amount.
You agree that TOSB may respond to you by electronic
mail with regard to any claim of unauthorized electronic
fund transfer that relates to the Online Banking
Service. Any such electronic mail sent to you by TOSB
shall be considered received within three (3) calendar
days of the date sent by the bank, regardless of whether
or not you sign on the Online Banking Service within
that time frame.
Disclosure of Account Information to Third Parties
We will disclose information to third parties about your
account(s) or the transactions that you make:
- When it is necessary for completing a
transaction; or
- To verify the existence and condition of your
account to a third party; or
- To comply with a government agency directive or
court order; or
- If you give us your written permission.

available on our web site.
Other Agreements
In addition to this Agreement, you and TOSB agree to
be bound by and comply with the requirements of the
agreements applicable to each of your Online
Accounts. Your use of Online Banking Service is your
acknowledgement that you have received these
agreements and intend to be bound by them. You
should review other disclosures received by you when
you open your account(s) at TOSB including the
charges that may be imposed for electronic funds
transfers or the right to make transfers listed in
the fee schedules accompanying those disclosures.
Complete Agreement
You acknowledge that you have read this agreement,
that you fully understand all terms and provisions
of the agreement and that you agree to be bound by
its terms. You further agree that this agreement and
any modifications made pursuant to it supersedes all
other proposals, whether oral or written, all other
between TOSB and you relating to TOSB’s Online
Banking Service.
In addition, you agree that you will use TOSB’s
Online Banking Service only in conjunction with
lawful purposes and will not use the Online Banking
Service for any activities in violation of any laws
or regulations.
Inactivity; Termination
You are responsible for complying with all the terms
of this Agreement, with the terms of the agreement
governing the deposit accounts which you access
using the service. We can terminate your electronic
banking privileges under this Agreement without
notice to you if you do not comply with the
agreement governing your deposit, loan accounts or
other accounts, or any account is not maintained in
good standing or if we have reason to believe that
the Service has been subject to unauthorized or
improper use. We will promptly notify you if we
terminate this Agreement or your use of the service
for any other reason.
We may convert your Online Banking Service access to
an inactive status if you do not sign on to the
service or have any transaction scheduled through
the Service during any consecutive ninety (90) days
period. If your Service access is considered
inactive, you must contact us, and there will be a
$4.50 fee to have the Service re-activated before
you will be able to use the service.
To cancel the Online Banking Service, you must
notify us and provide your name, address and the
effective date to stop the Service. You may notify
us by one of the following methods:

p.m. Central Time, Monday through Friday.

Governing Law
All applicable state and federal laws govern
this Agreement and the Online Banking Service.
Fee Schedule
Presently TOSB offers the benefits and
convenience of our Online Banking service to you
free of charge. Current fees may apply for
specific services. Please see your original
deposit account disclosure for more information.
